These Terms and Conditions of Sale (“Terms”) govern all purchases of goods and services (“Products”) from Fireworks Cookbook (“FWCB,” “we,” “us,” or “our”), through our website at https://fireworkscookbook.com or any other channel we control. By placing an order, you (“Buyer,” “you,” or “your”) agree to be bound by these Terms.
All sales by FWCB are made subject exclusively to these Terms. No additional, different, or conflicting terms in any purchase order or communication from Buyer will apply unless expressly agreed to in a written document signed by an authorized representative of FWCB. By submitting an order, Buyer acknowledges acceptance of these Terms.
FWCB reserves the right to refuse or cancel any order at its discretion, including where product availability, payment, or legal compliance issues arise.
Certain Products sold by FWCB are regulated and may only be purchased by individuals 18 years of age or older. For those Products, FWCB may require you to submit valid government-issued identification prior to shipment to verify your age and identity.
Orders placed without satisfactory proof of age when requested may be delayed or canceled. FWCB reserves the right to refuse service to anyone who fails to comply with verification requests.
Prices for all Products are determined by FWCB at the time of order. Unless otherwise stated in writing by FWCB, payment is required in full before shipment.
All prices are subject to change without notice. FWCB is not responsible for typographical errors or pricing mistakes on its website or invoices. In the event of a pricing error, FWCB reserves the right to cancel or correct affected orders.
All sales are final. Due to the nature of our Products — including chemicals and regulated materials — FWCB does not accept returns or provide refunds once an order has shipped.
Exceptions may apply only if FWCB ships the wrong item or if the Product is verified by FWCB to be defective or damaged upon arrival. In such cases, FWCB may, at its discretion, issue a refund or replacement.
Returned packages marked “Return to Sender (RTS)” will be refunded minus all shipping and handling fees.
FWCB is registered to collect and remit sales tax within the State of Georgia. Sales tax will automatically be applied to all orders shipped to a Georgia address unless a valid exemption certificate is provided prior to purchase.
Buyers outside of Georgia are responsible for reporting and paying any applicable use taxes in their jurisdiction.
FWCB will use commercially reasonable efforts to meet stated delivery dates and quantities. However, all shipping dates are estimates and subject to change. FWCB is not responsible for delays caused by carriers, weather, government actions, or other circumstances beyond its control.
If a shipment is returned to FWCB as “Return to Sender (RTS)”, a refund will be issued minus shipping and handling fees.

Our website may contain links to third-party websites or services not operated by FWCB. We do not control and are not responsible for their content, privacy policies, or practices. Visiting those sites is at your own risk. We encourage you to review the terms and privacy policies of any third-party websites you visit.
Buyer must inspect all shipments immediately upon receipt. Claims for shortages, defects, or nonconforming goods must be made in writing within ten (10) days of receipt. Failure to provide timely notice constitutes acceptance of the goods and waiver of any claims.
FWCB’s liability for defective Products is limited to, at our option:
At FWCB’s request, Buyer must return the defective items for inspection or disposal. FWCB will pay reasonable return shipping costs only when a product is confirmed defective.
Buyer agrees to comply with all applicable export control laws and regulations. Products purchased from FWCB may not be exported, re-exported, or transferred in violation of the U.S. Export Administration Regulations or U.S. Treasury Office of Foreign Assets Control regulations.
Buyer represents that it is not listed on any U.S. government restricted party list.
To the fullest extent permitted by law, FWCB’s total liability for any claim arising out of the sale or use of its Products will not exceed the purchase price paid for those Products.
FWCB shall not be liable for any incidental, indirect, or consequential damages, including loss of profit, loss of use, or injury to person or property.
Buyer agrees to indemnify, defend, and hold harmless FWCB and its officers, employees, agents, affiliates, and successors from any and all claims, damages, liabilities, and expenses (including attorney’s fees) arising out of:
Neither party shall be liable for failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, war, terrorism, labor disputes, natural disasters, or government actions. Payment obligations, however, are not excused by force majeure.
FWCB may suspend or terminate your access to the website or your account without notice if you violate these Terms or applicable laws.
Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (e.g., limitation of liability, indemnification) will remain in effect.
These Terms and any disputes arising out of the sale of Products shall be governed by the laws of the State of Georgia, United States of America, without regard to its conflict-of-law principles.
All disputes shall be resolved exclusively in the state or federal courts located in Americus, Georgia, and both parties consent to that jurisdiction and venue.
These Terms constitute the complete and exclusive agreement between Buyer and FWCB concerning the sale of Products and supersede any prior communications or agreements, written or oral.
No modification or waiver shall be effective unless in writing and signed by an authorized representative of FWCB. Electronic communications from Buyer (such as emails or online forms) do not amend these Terms.
